Revised Means Test Numbers-What This Means For You

Effective March 15: The Census Bureau's Median Family Income Data, Chapter 13 Administrative Expense Multipliers and IRS Allowable Living Expense figures are revised effective March 15th. You can also visit: www.justice.gov/ust/eo/bapcpa/meanstesting.htm for detailed information from the Department of Justice.

For you, this means that the bankruptcy courts have taken into consideration the increased standard of living and will allow greater deductions for your bankruptcy. Many debtors have become fearful of the new bankruptcy changes that came into effect 2005. There are changes but you still have rights so get legal advice before you feel that you are not eligible to file for bankruptcy.

Fight Back Against Credit Card Companies!!

Lots of consumers, just like you, believe that you have no recourse or actions against debt collectors, credit card companies or mortgage companies. But there is lots of help for you! The laws that work in your favor are the Fair Debt Collection Practices Act, Automobile Fraud laws, Truth in Lending laws, Fair Credit Reporting laws and the all-powerful: filing for Chapter 7 or Chapter 13 bankruptcy.
Just recently, we helped a consumer get her case dismissed in a suit that was filed against her for a credit card debt of $3,500.00. She was being sued by Asset Acceptance and we raised many defenses based on inaccurate pleadings and missing documents. Most debt collectors file lawsuits against consumers in bulk and these debt collectors hope that they can get a default judgment against you (by you ignoring the court notices and not showing up to court) or work out a payment plan with you in court. But before the case even gets to court, we have been successful in getting many suits thrown out because of sloppy filings.
The worst thing you can do is ignore letters from creditors. Don't do that. Read them and contact them or better yet, contact a consumer lawyer like us to help you out. You have rights you know. So don't be a victim - be proactive and let us help you know your rights.
